За время своего президентства Дональд Трамп неоднократно выказывал свое желание закрыть визовую лотерею (Diversity Visa Lottery). Но лидеру Белого дома так и не удалось осуществить задуманное, поэтому тысячи иностранцев снова получили шанс легально переехать в страну возможностей.
Госдепартамент США опубликовал окончательные результаты по Diversity Visa Lottery-2021. Стало известно, граждане каких стран иммигрируют в Штаты в 2021 году.
Лидером в списке счастливчиков, выигравших грин-карту, стали египтяне. Шанс сменить египетскую пустыню на американские каменные джунгли получили 6002 человека. Всего лишь на одного победителя меньше (6001) оказалось сразу в четырех странах.
Второе место разделили Россия, Судан, Иран и Алжир. Замыкает тройку лидеров Украина, где грин-карту выиграли 5604 жителя.
Далее следуют Узбекистан (5319), Конго (4503), Марокко (4458), Албания (3962), Эфиопия (3957), Непал (3801), Камерун (3686), Гана (3284) и Турция (2874).
Стоит отметить, что украинцы активно заполняют заявки на участие в Diversity Visa Lottery еще с 2000 года, тогда как россияне начали массово охотиться за удачей лишь с 2014 года, после оккупации Крыма.
Многие не поддерживают российские военные настроения, поэтому на сегодняшний день РФ является страной с наибольшим челом граждан, желающих покинуть родные территории.
Конгресс США одобрил программу розыгрыша грин-карт более 30 лет назад, иностранцы получили возможность иммигрировать в Штаты благодаря принятому закону Immigration Act of 1990.
С тех пор в стране ежегодно разыгрывается 55 тысяч грин-карт, шанс получить одну из них есть у жителей 170 разных стран.
Счастливчики, которые попадают в страну с выигранной грин-картой, после пяти лет проживания на территории США имеют право подавать заявление на получение американского гражданства.
Дональд Трамп больше 40 раз обещал прекратить действие программы визовой лотереи. Президент считает, что победители лотереи отнимают рабочие места у американцев и увеличивают нагрузку на социальные программы, становясь велферщиками.
Но дальше обещаний президента дело не дошло, Трамп не издал ни одного указа или постановления о закрытии визовой лотереи.
Следующий розыгрыш лотереи грин-карт (Diversity Visa Lottery-2022) пройдет с октября по ноябрь 2020 года.

Underused Program
In past years, chronic delays at American embassies and consulates around the world, due to the Covid-19 pandemic, among other causes, did not allow the qualified winners to complete the mandatory consular processing to get their green cards. For example, as of July 2021, the State Department had issued only around 3,506 visas out of 55,000 lottery winners, or according to the pro-immigration organization Immigrants List, a meager 6 percent of the visas available. One month later, by the end of September 2021, being the fiscal year end for the immigrant program, only some 7000 further visas were preserved for the winners. In short, the program’s 55,000 spots were significantly underused and many winners were left completely crestfallen. This has happened in the previous year as well. Needless to say, it does not exactly benefit the U.S. image overseas.
Congressional Action
Meanwhile, some members of Congress are trying to get legal relief for Diversity Green Card Lottery winners who have been denied their visas through the Keeping Our Promise Act. Introduced by Representatives Ritchie Torres (D-NY) and Judy Chu (D-CA), the bill would allow winners between 2017 to 2021 who were denied a visa because of COVID-19 restrictions or Trump-era travel bans to remain eligible for their visas. However, the bill does not appear to be likely to gain sufficient backers to succeed.

Diversity Green Card Lottery winners are facing the same constraints that other U.S. immigrants are facing. U.S. Embassies overseas are not open or are severely restrained in the cases they can process in view of the Covid-19 pandemic. The result has been that some winners have essentially “timed out.” To put it another way, they were only eligible in the year they won the lottery and needed to get their green cards that year or not at all.
Unlike other immigrants who are in line to be processed, such as for example family-based immigrant applicants, the cases of the Diversity Lottery winners do not automatically carry over into the next year’s processing batch of visas. It is little consolation for such applicants to be told that winning the lottery does not guarantee a U.S. visa. There is a bit of bate and switch involved in such an explanation. Perhaps the way the lottery should be presented is to say that the U.S. Diversity Green Card lottery is really a lottery to a dead end, except for a few thousand applicants who will be lucky enough to make it through each year.
The Greatness Of America At Stake
For many Americans, the failure of a few thousand applicants to get what they were supposed to get through the lottery will not be a matter of great concern. Some may even privately be happy the applicants will not be approved, given that they are not rich, highly skilled or accomplished. But for those who still believe in the American dream and a country that should be open to all kinds of immigrants, this shortcoming is a matter of significant concern. The greatness of America is sometimes best measured by how it addresses such smaller matters, even more so than, for example, in putting men and women into space. In this sense, the American leadership should do better to ensure that the Diversity Green Card Lottery program fulfills the purpose for which it was created, namely, to help ensure the diversity of the U.S. immigrant population.

A Final Court Hearing
Only a few days remain for the State Department to issue the remaining immigrant visas to the winners of the Fiscal Year-2021 Diversity Green Card Lottery program. Out of 55,000 FY-2021 Diversity Visas (DV) allotted by Congress, so far the State Department has issued less than 14,000. In the absence of an intervention by the court or Congress, the remaining visas will expire at the end of September 2021 and the immigration path for tens of thousands of DV-2021 winners will end. In the case of Goodluck v. Biden in the California U.S. District Court, attorneys for over 22,000 plaintiffs and family members will have a final opportunity to address their key concerns about the expiry of the rights of the lottery winners this week. A video conference before U.S. District Court Judge Amit Mehta has been scheduled for Monday, September 27th, 2021 for that purpose. The hearing will be accessible to the public at 11 AM EST here.
Struggle to Be Granted Immigrant Status
Among the Goodluck applicants are four Cuban families who were winners of the 2021 Diversity Visa Lottery who made the logistically complicated and incredibly expensive journey from Cuba to Georgetown, Guyana based only on their belief that, pursuant to a September 9th, 2021 order in the Goodluck case, they would be able to get interviews at the U.S. embassy there before the September 30 deadline. In a previous Goodluck court order, Judge Mehta ordered the State Department to make expeditious good faith efforts to adjudicate DV-2021 visas. But for these four Cuban families, that order hasn’t helped yet. For the Cuban immigrant visa applicants, the trip to Guyana was necessary because the U.S. Embassy in Havana has been closed for three years now. The trip required up to six flights and cost up to $5ooo per traveller. Equally difficult trips were made by Venezuelan lottery winners who travelled to Bogota, only not to be scheduled for interviews there. For these and the other plaintiffs in the case, the stakes are high.
Background of the Diversity Green Card Program
Immigration attorneys and others working in the field many years ago noticed that certain source countries like Mexico, China, India and the Philippines were flooding the U.S. with immigrants. On the flip side there were many countries that were underrepresented. For example, there were very few immigrants coming from African countries or smaller countries elsewhere. To address this imbalance they lobbied Congress to pass a law making up to 55,000 Diversity Visas available each fiscal year for persons coming from countries with low rates of immigration to the United States. To ensure fairness, the program introduced a yearly lottery so would-be immigrants from these disadvantaged countries could apply and stand an equal chance to come to the U.S. and at the same time diversify the incoming immigrant population. The Goodluck applicants are trying to take advantage of their success under this program.

Disappointing Contrast
In addition to the Cuban and Venezuelan applicants, there are over two thousand Afghan DV-2021 winners and their families anxiously waiting for immigrant visa interviews, yet zero interviews were granted to them by the U.S. Embassy in Kabul before it ceased operations on August 31, 2021 and the U.S. Embassy in Islamabad has notably turned away transfer requests from some of them, according to Morrison.

Many Afghan DV-2021 winners fear their lives are in danger for their plans to immigrate to the USA. Morrison represents 40 such Afghan DV-2021 families who are plaintiffs in the Goodluck law suit. According to Morrison, lawyers for the government have indicated that, “To the extent any DV applicants from Afghanistan have already travelled to a third country (or will travel) and have contacted the post in that country to request to have their DV case adjudicated at that post, then the post will make a decision based on its local COVID-19 conditions and available interview appointments.” However, Morrison believes more could be done to help such families gain access to the United States and will argue his case before the court.

Why The Program Works
There are two reasons why the Diversity Lottery is one of the best immigration programs in the United States. Firstly, it diversifies the in-bound immigrant population as Congress intended. While the beneficiaries of the program may have changed over time, the diversity element remains. Secondly, this is one of the few programs in which an average person, someone without family ties or personal connections or wealth, can qualify to immigrate legally to this country. This resonates deeply with American values.
Credibility At Stake
While the litigants in the Goodluck case will have one more chance to win relief in the U.S. District Court on September 27th, in the absence of an extraordinary order by the Judge, thousands of lottery winners are likely to lose their hard-won claims to immigrate to the U.S. this year. That will be a blow not only to those who were successful in the lottery, but to the credibility of the program and America as a whole.

Весна — особенно ожидаемое время года для участников лотереи Green Card. Каждой весной, 1 мая, проходит розыгрыш лотереи. Чтобы участвовать в весеннем розыгрыше, заявка должна была поступить во время предыдущего приёма заявок, который обычно заканчивается в конце октября или начале ноября. Розыгрыш проводит Kentucky Consular Center (KCC) — одна из структур Госдепартамента США. Именно KCC организовывает лотерею и работает с победителями.

Первые четыре цифры в номере заявки — это номер самой лотереи. Если номер заявки начинается с 2017, значит, эта заявка приняла участие в лотерее DV-2017. Номер лотереи — это не год приёма заявок и не год самого розыгрыша, а последний год выдачи виз победителям данной лотереи (фискальный год). Звучит сложновато, так что давайте разберёмся на конкретном примере:
Лотерея DV-2017: приём заявок — осень 2015 года, выбор победителей — весна 2016 года, выдача виз победителям — с 1/10/2016 по 30/09/2017 (таков период американского фискального года).
Проверить конкретную заявку можно только в течение 1 года (с начала мая того года, когда выбираются победители, по 30 сентября завершающего года, когда выдают визы). Например, срок проверки заявок DV-2017 — с 3/05/2016 по 30/09/2017. После завершения этого срока можно будет проверить только заявки следующей лотереи DV-2018.
Сейчас можно проверять заявки лотереи DV-2024.
Заявки лотереи DV-2025 можно будет проверить после 1 мая 2024 года.
В данный момент наблюдаются технические сложности при проверке. Возможно, вам придётся повторить попытку позже (например, через час).
