The Green Card Application


The green card application process will differ depending on if you are applying from within or outside the United States.

There are two main green card application forms:

Green card application (from within the US): Form I-485 (Application to Adjust Status). This form is used by those who are already in the U.S. on a nonimmigrant visa, have been selected for a diversity visa, or are eligible through family or employment.

Green card application (from outside the US): Form DS-260 (Immigrant Visa Electronic Application). This form is used by those who are seeking an immigrant visa from abroad, either through family, employer sponsorship or through the diversity visa program.

Green Card Timeline


The processing time for a permanent resident card is anywhere from a few months to many years, depending on the type of green card you’re applying for and where you’re applying from.

Applying from within the United States

For spouses and immediate relatives (parents and minor children) of U.S. citizens applying from within the United States through adjustment of status, the wait is currently 12.5-22.5 months. For spouses of U.S. green card holders, other relatives of U.S. citizens, and employment-based green cards, the wait can be much longer, typically two years or more.

Applying from outside the united states

For spouses and immediate relatives (parents and minor children) of U.S. citizens applying from outside the United States via consular processing, the wait is currently 13.5-15.5 months. All other green card categories are subject to country caps, and wait times vary dramatically.

For spouses of U.S. green card holders applying from outside the United States, the wait is currently – months.

Proposed Green Card Cost Increase 2023


The government filing fees for a green card could increase significantly in 2023 if a proposal by U.S. Citizenship and Immigration Services (USCIS) is approved. Earlier this year, the agency announced plans to raise the application costs for most visa application types, including forms I-130 and I-485. In addition, those adjusting their status to a marriage green card will have to pay fees on those applications as well. All told, the cost Adjustment of Status process (with work and travel) could increase by 90% this year, while the spousal visa process will be less impacted. The proposed fees are not yet in effect.

The process for getting a green card depends on which type you are applying for. Each of these is covered in detail below, starting with how to get a family-based green card.


Family-Based Green Card


IMPORTANT UPDATE (March 24, 2023):

The April 2023 Visa Bulletin saw a notable shift in the F-2A family-based category (Spouses and Unmarried Children (Under Age 21) of U.S. Green Card Holders). The “Final Action Dates” for these applications have stopped being “current” due to an increase in backlogs in the category. “Final Action Dates” refer to applications whose priority dates have reached the front of the line and can now be processed. However, these cases will NOT be adjudicated until the priority date is current. For Mexican applicants, the “Final Action Date” (or priority date) has retrogressed to November 1, 2018 and for all other applicants, the “Final Action Date” has retrogressed to September 8, 2020. This development is likely to lead to longer wait times for green cards under the F-2A category. Close relatives of U.S. citizens and current green card holders may apply for family-based green cards of their own. Eligible family members include spouses, children, parents, and siblings (as well as the spouses and children of those spouses, adult children, and siblings).

Also included in this category are widows and widowers who were married to a U.S. citizen at the time the citizen died. Like spouses of living U.S. citizens and current green card holders who apply for a marriage-based green card, widows and widowers must prove that their marriage was authentic in order to receive a green card.

Many extended family members — cousins, aunts and uncles, and grandparents — do not qualify. They may apply for a permanent resident card only if they, too, have a closer relative who is a U.S. citizen or current green card holder (or qualify for one of the other types of green cards below).


Employment-Based Green Card


Within the employment-based green card category, multiple subcategories of workers can apply for a permanent resident card. In some cases, their spouses and children may qualify for a green card, as well.

*Extraordinary ability is demonstrated “through sustained national or international acclaim. Your achievements must be recognized in your field through extensive documentation,” according to U.S. Citizenship and Immigration Services (USCIS).
**Exceptional ability refers to “a degree of expertise significantly above that ordinarily encountered” in your field.


Humanitarian Green Cards


For refugees and asylees

People who fear, or have experienced, persecution in their home country — because of their race, religion, nationality, political opinion, or membership in a particular social group — can seek protection in the United States by applying for a visa from abroad (to come as refugees) or from within the United States (to remain as asylees).

Once they have physically lived in the United States for at least one year since receiving refugee status or asylum, they may apply for a permanent resident card. Children and spouses (and in some cases, other family members) of refugees and asylees may also seek protection in the United States under these programs and eventually apply for a green card.


For human-trafficking victims

Victims of human trafficking who are living in the United States — whether lawfully or unlawfully (in other words, “undocumented”) — may apply for a T visa to stay in the United States for up to four years. As a condition of the T visa, however, they must help to investigate and prosecute perpetrators of human trafficking (unless the victim is under age 18, in which case they need not help with such efforts).

  • Three years since receiving a T visa
  • The duration of an investigation or prosecution of human trafficking

They must also meet other eligibility requirements. These include, for instance, demonstrating “good moral character” (meaning they have not committed certain crimes, such as fraud, prostitution, or murder) from the time they received a T visa until they’re approved for a green card. As another example, they must demonstrate to the U.S. government that they would suffer extreme hardship involving severe harm if they were required to leave the United States. (USCIS provides the full list of eligibility criteria.)

Certain family members will also be eligible to apply for their own green cards as long as both those relatives and the victim satisfy all requirements.


For crime victims

Victims of “substantial physical or mental abuse” who are living in the United States — whether lawfully or unlawfully (in other words, “undocumented”) — may seek protection by applying for a U visa. To obtain a U visa, the victim’s application must be certified by a law enforcement agency. Like recipients of T visas (see above), an applicant for a U visa must also agree to help investigate and prosecute people who commit certain crimes, such as kidnapping, sexual assault, and torture.

  • They must have physically lived in the United States for at least three years since receiving a U visa.
  • They must not have left the United States from the time they applied for a green card until USCIS has approved (or denied) their application.
  • They must not have refused to help investigate or prosecute certain crimes from the time they received a U visa until USCIS approves (or denies) their green card application.

The victim’s children, parents, siblings, and spouse will also be eligible to apply for their own green cards as long as both those relatives and the victim satisfy all requirements.


For abuse victims

Victims of domestic violence (battery or extreme cruelty) may apply for a green card that would allow them to seek relief through the Violence Against Women Act (VAWA). Although this law was created to benefit women, it applies to both women and men, and both parents and children, who are victims of abuse.

An abuse victim may apply for a permanent resident card on their own — without the knowledge or permission of their abusive relative, who can include:

  • A current or former spouse who is a U.S. citizen or green card holder
  • A parent who is a U.S. citizen or green card holder
  • A child who is a U.S. citizen

USCIS will not notify the abusive relative of the application in order to keep the victim safe. (Full eligibility requirements are detailed on the USCIS website.)

IMPORTANT: If you or someone you know is experiencing domestic abuse now, contact the National Domestic Violence Hotline right away at 1-800-799-7233 or 1-800-787-3224 (TTY). You’ll be able to talk with someone about available resources, such as shelters, mental health care, and legal assistance. The hotline also provides information about green cards through VAWA.


Diversity Lottery Green Card


Most lottery applicants live in their home countries at the time they cast their entries, but some already live in the United States under a different type of immigration status.


Longtime-Resident Green Card


Individuals who have physically lived in the United States — lawfully or unlawfully (meaning you were “undocumented”) — since January 1, 1972 may apply for a permanent resident card through a special process called “registry.”

  • They entered the United States before January 1, 1972, which they would need to prove by providing an I-94 travel record (officially called the “Form I-94 Arrival/Departure Record”).
  • They have not left the United States since arriving.
  • They have “good moral character,” meaning they have not committed certain types of crimes, such as fraud, prostitution, or murder (see more info on “Good Moral Character“).
  • They’re eligible for U.S. citizenship through naturalization.
  • They have not committed crimes that would make them “deportable” (able to be sent back to their home country). Examples of such violations include drug abuse, smuggling, and marriage fraud (marrying a U.S. citizen or green card holder to obtain a marriage-based green card).
  • They have not committed crimes that would make them “inadmissible” (meaning they cannot receive a green card). Examples of such violations include entering the United States unlawfully and staying more than six months in the United States with an expired visa.


Other Green Cards


The U.S. government issues many other types of green cards besides the ones discussed above. Some of these include permanent resident cards for “special immigrants,” including media professionals, religious workers, Afghanistan and Iraq nationals who have served the U.S. government under certain capacities, and other types of workers who have served in an international organization. Others include green cards for Cuban citizens and American Indians born in Canada.

Located within this string of characters is a lot of important information, including your green card number, which is unique to each green card holder.

Where is the Green Card Number?


The green card number — also known as the receipt number or the permanent resident number — is located on the bottom of the back of the card, in the first line of a long string of 90 characters. The less than symbols are there simply as space holders.

Green Card Number Format


And then, finally, the green card number starts. This series begins with 3 letters, which indicate the service center which received the case for residency status:

CSC – California Service Center

EAC – Eastern Adjudication Center (now known as Vermont Service Center)

IOE – ELIS (efile)

LIN – Lincoln Service Center (now known as Nebraska Service Center)

MSC – Missouri Service Center (now known as National Benefits Center)

NBC – National Benefits Center

NSC – Nebraska Service Center

SRC – Southern Regional Center (now known as Texas Service Center)

TSC – Texas Service Center

VSC – Vermont Service Center

WAC – Western Adjudication Center (now known as California Service Center)

YSC – Potomac Service Center

After the service center code are two digits that represent the fiscal year the case was received. This might not match what your calendar says, because the U.S. government’s fiscal year runs from October 1 through September 30. As an example, this means a case received October 15, 2019 would have a fiscal year two digit code of 20.

The last 5 is your unique immigrant case number — the number of the approved case that resulted in a green card being granted to you.

Together this string is the format of the green card number. If the case number for the example above was 51423, the full green card number would read: NBC2004551423.

Looking at the sample card in the image, for the woman named Test V. Specimen, her green card number reads: SRC0000000001.

If you’re wondering about the rest of the numbers, the second line includes your birth date in year-month-date (YY/MM/DD) format, gender, expiration date of the card (YY/MM/DD), a country of birth and some space holders. The third line will contain your last name, first name, father’s first initial, mother’s first initial, and more space holders if needed.

Green card. It’s a term that is used often. But people don’t use the term very carefully. What does “green card” actually mean under the United State’s Immigration and Nationality Act?

“Green card” simply has no legal meaning whatsoever. Instead, it’s basically immigration slang. The problem is that people use it to refer to at least three immigration concepts. And these three concepts are very different from one another. Let’s have a look.

Green card meaning #1 – lawful permanent residency.

People most often use the term “green card” to refer to the concept of lawful permanent residency. A lawful permanent resident or LPR has the ability to live and work indefinitely in the United States. That means, unless the person does something to lose her status, she can live and work in the U.S. for as long as she wants. LPRs are still subject to immigration law, however. So if the person commits a crime, for example, she can be placed into deportation proceedings and lose her “green card.”

LPRs are also subject to restrictions on foreign travel. The purpose of this “green card” is to live in the United States. Under immigration law, if the person spends too much time outside of the country, the person is considered to no longer be a U.S. resident. As a general rule, the “green card” holder should not spend more than 6 months at a time outside of the United States.

How does someone get residency status? The most common route is through a family member. The process is different depending on whether the person is inside the United States already or applying from outside the United States. Additional routes include less common strategies like U-Visas for crime victims or VAWA petitions for abuse survivors. In limited situations, an employer may start the petition process. But this is generally limited to certain high-skill jobs.

Green card meaning #2 – work permit.

But there are many, many other forms of temporary work visas. Each of these is designated by a letter of the alphabet. So this is sometimes referred to as the “alphabet soup.” Some common examples of temporary visas include:

It is important to understand that there is no general line to “stand in” for a temporary work permit. The ability to apply is always tied to a particular work authorization category, such as the ones listed above.

Green card meaning #3 – U. citizenship.

This last use of the term “green card” is just completely wrong and totally misleading. But even lawyers sometimes don’t understand the difference between U.S. citizenship and lawful permanent residency. For most of our clients, the most important difference is that U.S. citizens are no longer subject to U.S. immigration law. That is, they can come and go from the U.S. as they please, and it’s almost impossible to lose status as a U.S. citizen. Citizens – but not residents – have the right to vote in federal elections. Once someone has become a citizen, they are considered a full member of our society. As we always tell our clients, once they become citizens they have exactly the same rights and responsibilities as any other American.

Conclusion – no more “green card

Instead of using the term “green card,” we encourage you to use the more accurate immigration concept. If you mean lawful permanent residency, say so. If you’re referring to temporary work authorization, be clear. This will help you communicate more clearly, whether to a lawyer or someone else. It also shows that you know what you’re talking about.

Документы для грин-карты

После одобрения заявки все кандидаты проходят собеседование в посольстве США.

В 2021 году все консульства США на территории России прекратили свою работу, поэтому пройти интервью в РФ нельзя. Победителям лотереи назначают собеседование в посольстве США в Польше.

Однако здесь есть еще одна сложность. Польша не выдает визы россиянам, и въехать туда можно только по уважительной причине.

Чтобы обойти запрет вы можете сначала отправиться, например в Германию, а оттуда уже вылететь в Польшу. Либо попросить перенести интервью в другую страну — например, Сербию.

  • Low probability of winning — about one percent.

What is a Green Card

The owner of a Green Card is considered a permanent resident of the United States — they have the right to work, study and use a limited set of services from the government. In addition, all cardholders can receive a driver’s license, own property in the country, get discounts on tuition and borrow loans on preferential terms. After five years of living in the country, a permanent resident can apply for US citizenship, and after ten — for retirement benefits.

How a Green Card differs from citizenship

Despite the fact that the cardholder lives in the country without time limits, the list of their social benefits is limited. They remain a citizen of their home country, cannot take part in referendums, elections, or work in government services. In addition, there are restrictions on entry for relatives, while family members of a US citizen receive a visa under simplified conditions.

It is more difficult to obtain citizenship than a Green Card — a candidate takes an exam on knowledge of history and culture, proves their high moral qualities, and takes an oath. The Immigration Service conducts an interview and tests candidates for basic English reading, writing, and speaking skills. But the efforts are worth it — the citizen gets the right to vote, travel without a visa to most countries of the world, and apply for employment in federal agencies. Moreover, students have access to all state scholarships and can leave the country without fear of being deported upon returning.

How to get a Green Card

You can get a Green Card in different ways. Below are the main ones.

  • Family reunification. For close relatives of a US citizen and their family members — siblings and children;
  • Employment. After an American employer officially confirms that they are ready to hire you, you receive a Green Card. The important conditions are a higher education degree and relevant work experience;
  • Programs for talented people. This method is suitable for winners of international competitions, scientists who have made discoveries, recognized artists, and others. To receive a Green Card, you must confirm that you intend to continue your professional activities in the United States;
  • Investment. Five years after investing at least 900,000  in a company in the United States, you get the right to apply for citizenship. Funds must be obtained legally, and the company has to employ at least ten people;
  • Winning the diversification lottery. It has been held since 1995 by the US Department of State. To participate, a candidate’s portfolio must match several simple criteria. More about them in the next section.

Green Card lottery

US government allocates 55,000 Green Cards annually to diversify the nation’s ethnic composition. The Diversification Lottery is meant for the residents of countries with low rates of immigration to America. The US Department of State deliberately distributes a different number of free Green Cards between countries. For example, the maximum possible number of winners from Latvia is 64, and from Russia — 2290. Each application has an equal chance of winning — the computer selects the lucky ones at random. Winning does not oblige you to do anything, but it lets you apply for an immigrant visa, and then for a Green Card after entering the United States.

Who can participate in the Green Card lottery

To participate in the lottery, you must fulfill several simple conditions:

  • Live in a state that is allowed to participate in the lottery. The list is updated annually. Usually, residents of Canada, Mexico, Great Britain, and India do not participate in the lottery. When filling out the application, you may encounter some nuances. For example, Crimea belongs to the consular district of the US Embassy in Kyiv, and residents of the city apply for an immigration visa in Ukraine, despite being Russian citizens. Similar specificities may apply to other regions of the world. Therefore, check the information in advance;
  • Complete secondary education or have two years of work experience that meets a number of conditions. It is not enough just to find employment — you must work in your specialty and have at least two years of professional education. Use the site O*NET to see if you qualify for this criterion;
  • Obtain a foreign passport. If the application form is issued for the whole family, then at least the main applicant must have a passport.
How to evaluate the experience of working on the O*NET site
  • Go to the appropriate section;
  • Choose your specialization;
  • View specifications in Job Zone and SVP:

    • Job Zone assesses how long it takes to master a profession. The minimum score is 1 (no need to study), the maximum is 5 (a serious level of education is required);
    • SVP — Specific Vocational Preparation. The term applies to those who do not have secondary education. With SVPs, you prove that you have learned the necessary skills in practice. If over the last five years you have worked for two years in positions from 7.0 on SVP, then you can participate in the lottery.
  • Consider the minimum requirements:

    • Job Zone: 4 or 5;
    • Specific Vocational Preparation: from 7.0.
Which countries cannot participate in the lottery

Lottery winners and entrants are not required to prove their level of English. Even those who do not know a word in a foreign language can receive a Green Card.

How much does it cost to participate in the Green Card lottery

An application for participation is free. But it is pointless to start the immigration process without sufficient financial resources. The winners pay visa fees and otherwise prepare the documents — only these procedures cost about 1,000  per person. Also, a candidate for a Green Card needs to prove the financial solvency to fly to and live in the country.

How to increase the chances of winning the Green Card lottery

Every year, about five million people participate in the lottery, and only 55 thousand win. This means that the chance of winning is approximately 1.1%. But it is worth remembering that the department issues a different number of cards to countries. Therefore, residents of one state have a slightly greater chance than others.

If you have an official spouse or unmarried children under the age of 21, you can increase your chances of winning the lottery by registering them in it as well. They automatically receive a Green Card along with the winner.

В 2021 году все консульства США на территории России прекратили свою работу, поэтому пройти интервью в РФ нельзя. Победителям лотереи назначают собеседование в посольстве США в Польше.

Однако Польша в 2022 году приостановила выдачу виз россиянам. Въехать туда можно только по уважительной причине. Вы можете сначала отправиться, например, в Германию, а оттуда уже вылететь в Польшу. Либо попросить перенести интервью в безвизовую страну — Сербию, Армению или Казахстан.
